These Terms & Conditions (the “Terms”) govern your access to and use of the RentUs website, applications and services (together, the “Platform”), operated by CONNECTIVE S.L., with tax ID (NIF/CIF) B88980784 and registered office at Paseo del Born 12, 07012 Palma de Mallorca, Spain (“RentUs”, “we”, “us”).
By creating an account, listing an item, making a booking, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.
1.Who we are and what RentUs does
RentUs operates an online marketplace that connects people who wish to rent vehicles, boats and transfer services in Mallorca and the Balearic Islands (“Renters”) with independent third-party businesses and individuals who offer those items and services (“Operators”).
RentUs is an intermediary only. The rental or service contract for any booking is concluded directly and exclusively between the Renter and the Operator. RentUs is not the owner, lessor, operator, carrier, captain or provider of any vehicle, boat or service listed on the Platform, is not a party to that contract, and does not assume any obligations or liabilities of the Operator.
2.Definitions
- Listing — an offer published by an Operator for a car, boat, transfer or related service.
- Booking — a Renter's confirmed request to rent a Listing for specified dates/times.
- Booking Total — the amount payable by the Renter for a Booking, as shown at checkout.
- Commission — the service fee RentUs charges the Operator, deducted from the Booking Total.
- Content — any text, photos, prices, reviews or other material submitted to the Platform.
3.Eligibility and accounts
- You must be at least 18 years old and have full legal capacity to enter into contracts.
- You must provide accurate, current and complete information and keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- You may not use the Platform if you are barred from doing so under any applicable law.
- We may refuse, suspend or terminate accounts at our discretion, including for breach of these Terms.
4.Bookings and the request-to-book process
How a booking is made
When a Renter requests a Booking, their payment method is authorised (pre-authorised) but not charged. The Operator then has a limited window (by default 24 hours, and never longer than the rental start time) to accept or decline. The Renter is only charged when the Operator accepts; if the Operator declines or the window expires, the authorisation is released and no charge is made.
The contract
Acceptance by the Operator forms a binding rental/service contract between the Renter and the Operator on the terms of the Listing, these Terms, and any additional conditions the Operator lawfully communicates (e.g. fuel policy, security deposit, licence requirements, house/boat rules).
Accuracy
RentUs does not guarantee the availability, quality, safety, legality or accuracy of any Listing. Photographs and descriptions are provided by Operators.
5.Prices, fees and payments
- Prices are set by Operators and displayed in euros (€), inclusive of applicable taxes unless stated otherwise.
- Payments are processed by our payment provider, Stripe, including via Stripe Connect for payouts to Operators. By using the Platform you agree to Stripe's applicable terms. RentUs does not store full card details.
- RentUs charges Operators a Commission of 10% of the Booking Total, which is inclusive of any applicable VAT (IVA) and is deducted automatically from the Operator's payout. RentUs issues the Operator a corresponding commission invoice.
- Security deposits, fuel, fines, tolls, cleaning and damage charges are matters between the Renter and the Operator.
Payment processing fees
Card and payment-processing fees charged by Stripe or other providers may apply in addition to the Commission, and may vary depending on the payment method, card issuer, country of issuance, currency conversion and other factors. Such processing fees may be non-refundable, including where a Booking is refunded. Where a processing fee, refund, chargeback or other amount is owed by an Operator and cannot be collected from their payout or payment method, RentUs is not liable for it and may recover it by any lawful means, including set-off against future payouts.
Fee changes
RentUs may modify its fees or fee structure at any time, with reasonable prior notice for changes that affect you.
5a.Payouts to Operators
- Amounts collected from Renters are held and processed via our payment provider and paid out to the Operator after the rental, less the Commission and applicable fees.
- Payouts are released in accordance with our payout schedule — typically 10 days after the rental ends — subject to successful completion and the absence of any dispute.
- RentUs may withhold, delay, set off or reverse payouts where reasonably necessary for fraud prevention, dispute or chargeback investigation, refunds, regulatory compliance, suspected breach of these Terms, or risk management.
- Operators are responsible for providing valid payout details and completing any identity/verification (KYC) checks required by Stripe; payouts cannot be released until these are complete.
6.Cancellations, refunds and no-shows
Each Booking is subject to the cancellation conditions shown at the time of booking and/or set by the Operator. Where a Renter cancels, refunds (if any) are determined by those conditions. Where an Operator cancels a confirmed Booking, the Renter is refunded the amounts paid for that Booking. RentUs may retain or refund its Commission in accordance with these Terms and applicable consumer law.
Statutory withdrawal rights for consumers may be limited or excluded for short-term vehicle and boat rental and leisure services with a specific date or period of performance, as permitted under EU and Spanish consumer law.
7.Operator obligations
- Hold all licences, registrations, permits, ITV/seaworthiness certificates and insurance required by law.
- Ensure every vehicle or vessel is roadworthy/seaworthy, safe, clean and as described.
- Comply with all applicable maritime, transport, tax, consumer-protection and safety regulations.
- Set accurate prices, availability, licence/skipper requirements and deposit terms.
- Honour confirmed Bookings and deal fairly with Renters.
- Issue Renters any legally required invoices for the rental itself (RentUs is not a party to that contract).
8.Renter obligations
- Hold a valid driving licence (for cars) or any required boating licence/qualification, or hire a skipper where required.
- Meet minimum age and any other requirements stated in the Listing.
- Use the item lawfully and responsibly, return it on time and in the condition received (fair wear and tear excepted).
- Pay for fuel, deposits, fines, damage and any agreed extras as required by the Operator.
- Not be under the influence of alcohol or drugs while operating any vehicle or vessel.
9.Prohibited conduct
You agree not to:
- Circumvent the Platform to avoid fees, or take payments/communications off-platform to evade these Terms.
- Post false, misleading, infringing, unlawful or harmful Content, or manipulate reviews.
- Use the Platform for fraud, money laundering, or any illegal purpose.
- Interfere with, scrape, or attempt to gain unauthorised access to the Platform or its systems.
10.Reviews and content
You retain ownership of Content you submit but grant RentUs a worldwide, royalty-free, sub-licensable licence to host, use, display and promote it in connection with the Platform. You are responsible for your Content and warrant that you have the rights to submit it. We may remove Content that breaches these Terms.
11.Insurance and risk
Insurance for vehicles and vessels is the responsibility of the Operator and, where applicable, the Renter, as set out in the rental contract. RentUs does not provide insurance and is not responsible for claims, excess, damage, theft, injury or loss arising from any rental.
12.Disclaimers
The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, RentUs disclaims all warranties, express or implied, regarding the Platform and any Listings, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure.
As an intermediary, RentUs is not responsible for, and disclaims liability for, any of the following arising from a rental, service or experience booked through the Platform:
- accidents, personal injury, death, or harm to any person;
- damage to, theft of, or loss of any property;
- mechanical, technical or equipment failure;
- delays, weather or sea conditions, or force majeure;
- service interruptions, no-shows, or cancellation by an Operator or Renter;
- the acts, omissions, negligence or misconduct of any Operator or Renter;
- any Operator's lack of required licences, permits, insurance or legal compliance.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for death or personal injury caused by our own negligence, for fraud, or your statutory consumer rights.
13.Limitation of liability
To the maximum extent permitted by law, RentUs (and its officers, employees and agents) shall not be liable for the acts or omissions of any Operator or Renter, for the condition, safety or legality of any item or service, or for any indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data or goodwill.
Where RentUs is found liable notwithstanding the above, our aggregate liability to you for any claim arising out of or relating to the Platform is limited to the greater of (a) the total Commission actually retained by RentUs on the Booking giving rise to the claim, (b) the total fees paid to RentUs by you in the twelve (12) months before the claim, or (c) €100. This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited under applicable law.
14.Indemnity
You agree to indemnify and hold harmless RentUs from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Platform, your Content, your breach of these Terms, or your rental/provision of any item or service.
15.Disputes between users
Disputes arising from a rental are between the Renter and the Operator. RentUs may, at its discretion and without obligation, help facilitate resolution, but is not responsible for the outcome.
16.Suspension and termination
We may suspend or terminate your access at any time for breach of these Terms or applicable law, or to protect the Platform or its users. You may stop using the Platform at any time. Provisions that by their nature should survive termination will survive.
17.Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Platform or by email. Continued use after changes take effect constitutes acceptance.
18.Governing law and jurisdiction
These Terms are governed by the laws of Spain. Subject to any mandatory consumer-protection rights to bring proceedings in your place of residence, the courts of Palma de Mallorca, Spain shall have jurisdiction. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
